1. Scope of This Privacy Policy
This Privacy Policy explains how TheoTrade, LLC (“TheoTrade,” “we,” “us,” or “our”) collects, uses, discloses, stores, and protects information in connection with our websites, including TheoTrade.com, mobile applications, member areas, subscriptions, store, content, products, services, communications, trade alerts, market commentary, editorial content, educational content, live rooms, webinars, events, video, audio, written reports, emails, SMS/text messages, app notifications, push notifications, in-app messages, and any other digital channels, features, functionality, or content that we make available now or in the future, collectively, the “Services.”
This Privacy Policy does not apply to websites, apps, platforms, services, or privacy practices of third parties, even if they are linked to, embedded in, or accessible from the Services. We recommend that you review the privacy policies of other parties with which you interact.
By accessing or using the Services, creating or logging into an account, purchasing or maintaining a subscription, downloading or using the TheoTrade mobile app, enabling notifications, or otherwise interacting with the Services, you acknowledge the practices described in this Privacy Policy.
2. Personal Information and Other Information We Collect
For purposes of this Privacy Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person, household, account, or device, subject to applicable law. Personal Information may include name, email address, telephone number, account identifiers, device identifiers, app identifiers, Internet Protocol (IP) address, app usage information, and similar information.
We may collect information you provide directly, information collected automatically when you use the Services, information collected through our mobile app and app-related technologies, information from service providers and business partners, and information from other sources as described below.
3. Information You Provide to Us
We may ask you to provide Personal Information when you use the Services; create or update an account; register for a membership or subscription; place orders; request services, support, downloads, trials, whitepapers, or information; register for events, classes, webinars, or live rooms; participate in surveys, sweepstakes, or promotional activities; subscribe to newsletters, TheoTrade programs, promotional emails, alerts, SMS/text messages, or other materials; contact us; submit feedback, questions, support requests, testimonials, chat messages, or other content; or otherwise interact with TheoTrade.
Information we request may include your email address, name, home or mailing address, telephone number, mobile number, date of birth, account credentials, payment and billing information, and preferences. If you make a purchase, payment information may be collected or processed by TheoTrade or by third-party payment processors. Forms you choose to complete may indicate whether the information requested is mandatory or voluntary.
4. Mobile App Data We Collect
When you install, access, or use the TheoTrade mobile app, we may collect information from or about your device, app, account, and interactions with the Services. Based on the current app configuration, the app is a Flutter-based iOS and Android app that communicates with the TheoTrade/WisePub backend over HTTPS, uses Firebase Cloud Messaging for push notifications, Firebase Analytics for app analytics, Firebase Crashlytics for crash reporting, and Cloudflare in front of the backend.
Mobile app information we may collect includes:
- name, email address, optional phone number, TheoTrade user ID, member ID, account information, subscription status, channel subscriptions, and per-channel alert preferences;
- device type, device model, operating system, operating-system version, app version, language settings, time zone, carrier or network information, IP address, and general location derived from IP address;
- push notification tokens, platform information, device name, and related notification-delivery information needed to send app alerts;
- login, sign-up, authentication, session, access, and account-security information, including bearer tokens stored on your device in secure storage;
- app usage information, session metrics, screen views, app engagement information, and custom events such as login, sign-up, and announcement-open events;
- information about whether an announcement was opened from the feed or from a push notification, when that event is logged by the app;
- crash logs, fatal-error reports, stack traces, device state, app version, operating-system version, and related diagnostic information collected through Firebase Crashlytics in release builds;
- request metadata such as IP address and user-agent information that may transit Cloudflare and the TheoTrade/WisePub backend when the app communicates with the backend;
- information you submit through the app, such as support requests, preferences, feedback, account-deletion requests, or other information you provide.
The current app does not request or collect precise GPS location, camera access, microphone access, photos/media-library access, contacts, Bluetooth access, advertising identifiers such as IDFA or AAID, App Tracking Transparency permission, social-login credentials, or in-app purchase information through Apple StoreKit or Google Play Billing.
Some information collected through Firebase Analytics and Crashlytics is associated with an internal TheoTrade/WisePub numeric user identifier. That data does not include your name, email address, or phone number when sent to Firebase, but it may be pseudonymous and linkable to your TheoTrade account by TheoTrade because TheoTrade controls the identifier mapping. We therefore do not treat this data as fully anonymous.
5. Information Collected Automatically Through Websites, Cookies, Pixels, and Similar Technologies
We may collect information about your visits to our websites and web-based Services, including pages viewed, links and advertisements clicked, search terms entered, Content viewed, purchases made, emails opened, and other actions taken in connection with TheoTrade websites, emails, and services. We may also collect information from the browser, device, or app you use, such as IP address, browser type and language, access times, referring URLs, device information, and similar information.
TheoTrade websites, emails, and web-based Services may use TheoTrade and third-party cookies, web beacons, pixel tags, tracking links, local storage, mobile SDKs, analytics tools, and similar technologies to enable sign-in, remember preferences, support shopping-cart functionality, personalize online experiences, measure email and advertising performance, understand usage, and improve the Services.
Some marketing you receive, including email marketing, may be personalized based on your visits to TheoTrade websites, app usage, browsing history, purchase history, Content engagement, or other interactions with the Services, where permitted by law and subject to your choices. When you click links in emails or other digital communications, our service providers may collect information such as email address, IP address, device information, products and services viewed, and purchase activity to help personalize or measure future communications.
You may control certain cookies through your browser settings. If you decline or disable cookies, you may not be able to sign in or use certain interactive features of the Services.
Do Not Track and opt-out preference signals. Some browsers transmit Do Not Track (DNT) signals. Because no common industry standard for DNT has been adopted, our websites do not currently respond to DNT signals. We honor opt-out preference signals such as the Global Privacy Control (GPC) as a valid request to opt out of the sale or sharing of Personal Information for the browser or device that sends the signal, as described in Section 19. As described in this Privacy Policy, third parties may collect information about your online activities over time and across different websites when you use the Services.
6. Embedded Content, WebViews, and Third-Party Video Hosts
The mobile app and other Services may display TheoTrade web content, legal pages, support pages, announcement HTML, or embedded video/audio content through an in-app webview or browser. If an announcement or page contains embedded video or audio, such as content from YouTube, Vimeo, or another third-party host, that third-party host may collect information, set cookies, log playback or interaction activity, or otherwise process information under its own terms and privacy policy. TheoTrade does not control the privacy practices of those third-party hosts.
7. How We Use Personal Information and Mobile App Data
We may use Personal Information, mobile app data, website data, communication data, and other information we collect to:
- operate, maintain, secure, and improve the Services, including the TheoTrade mobile app, websites, member areas, live rooms, videos, audio, reports, alerts, and communications;
- authenticate users, manage accounts, verify subscription and member access, manage channel subscriptions and alert preferences, process transactions, and provide account-related functionality;
- deliver TheoTrade Content, trade alerts, market commentary, editorial content, educational content, live rooms, video, audio, written reports, webinars, events, product updates, and other Services;
- send, manage, personalize, and measure push notifications, app notifications, in-app messages, email, SMS/text messages, account notices, and other communications;
- send trade-alert and editorial/content push notifications at launch, and send promotional push notifications in the future only where permitted by law, app-store rules, and any required user consent and opt-out controls;
- measure engagement with alerts, notifications, editorial content, educational content, videos, audio, live rooms, products, services, and promotions;
- analyze product usage, app usage, screen views, sign-up and login events, announcement-open events, session activity, and other engagement metrics;
- personalize and improve Content, user experience, app functionality, recommendations, communications, and advertising where permitted by law;
- troubleshoot errors, crashes, performance problems, access issues, delivery failures, and other technical issues;
- provide customer support and respond to requests, questions, complaints, deletion requests, and account inquiries;
- prevent, detect, investigate, and address fraud, unauthorized access, misuse, security incidents, prohibited activity, and violations of our Terms of Use;
- comply with legal, regulatory, contractual, accounting, security, recordkeeping, and compliance obligations;
- enforce our Terms of Use and protect the rights, property, safety, and security of TheoTrade, our users, our service providers, and others;
- perform any other purpose disclosed to you at the point of collection or with your consent where required by law.
8. How We Disclose Information
We may disclose Personal Information and other information to service providers, vendors, business partners, contractors, and other third parties that help us operate the Services, carry out transactions, provide subscriptions, maintain accounts, deliver Content, send communications, provide push notifications, host infrastructure, process payments, provide customer support, measure analytics, report crashes, prevent fraud, protect security, comply with law, or otherwise perform services on our behalf.
Categories of third parties that may receive information include hosting providers, backend service providers, cloud infrastructure providers, Cloudflare or similar security/CDN providers, Google/Firebase for push notifications, analytics, and crash reporting, payment processors, email and SMS providers, customer support tools, app stores, operating-system providers, analytics providers, video/audio platforms, legal and compliance providers, and other vendors that support the Services.
We may disclose information to business partners, channel partners, affiliates, successors, or acquirers in connection with requested transactions, co-branded services, sales or marketing support, a merger, acquisition, financing, reorganization, dissolution, sale, transfer, or other disposition of all or part of TheoTrade or its assets, subject to applicable law.
We may disclose information in connection with law enforcement, fraud prevention, security, legal process, regulatory requests, court orders, subpoenas, litigation, investigations, or to protect the rights, property, safety, and security of TheoTrade, our users, our service providers, or the public.
Except as described in this Privacy Policy or as permitted by applicable law, we do not disclose Personal Information to third parties for their own marketing purposes without your consent.
9. SMS Information
We do not share mobile information with third parties or affiliates for marketing or promotional purposes. SMS opt-in information and consent will not be shared with any third parties, except as required to provide customer support or operate our messaging services.
Message frequency will vary. Message and data rates may apply. Additional SMS terms, including STOP and HELP instructions, are described in Section 11 below.
10. Push Notifications, SMS, Email, and Communication Preferences
You may receive communications from TheoTrade through email, SMS/text message, telephone, push notification, app notification, in-app message, postal mail, and other digital channels. Some communications are transactional or service-related, including account notices, legal notices, billing notices, subscription notices, purchase confirmations, security alerts, and customer-support messages. You may not be able to opt out of these communications while maintaining an account, subscription, or active relationship with us.
At launch, push notifications may include trade alerts, market commentary, editorial content, educational content, account or service updates, and content or event reminders. The app does not currently use push notifications for promotional offers. TheoTrade may offer promotional push notifications in the future only where permitted by law, app-store rules, and any required user consent and opt-out controls.
Push notifications are delivered using Firebase Cloud Messaging. The app obtains a push notification token after notification permission is granted and registers that token with the TheoTrade/WisePub backend along with platform, device name, and app version so that alerts can be sent. The app does not track notification dismissals or link clicks. A tap that opens an announcement may log an announcement-open event indicating that the source was push. Firebase may provide aggregate send or delivery counts in the Firebase console for certain notification-type messages.
You may opt out of marketing emails by clicking the unsubscribe link in an email or by contacting [email protected]. You may opt out of SMS/text messages by replying STOP to a TheoTrade text message, where available, or by following the instructions provided in the message. You may manage or disable push notifications through the TheoTrade app settings and/or your device settings.
Push notifications, SMS/text messages, and email are separate communication channels. Disabling push notifications does not automatically unsubscribe you from SMS/text messages or email. Replying STOP to SMS/text messages does not automatically disable push notifications or unsubscribe you from email. Unsubscribing from email does not automatically disable push notifications or unsubscribe you from SMS/text messages. Each channel is managed independently, although the channels may be linked to your TheoTrade user record for account and communication-management purposes.
11. SMS Policy
TheoTrade may send alerts, updates, trading topics, educational content, account/service updates, and promotional messages via SMS/text messaging where permitted by law and subject to your consent and communication preferences. Message frequency will vary.
You may cancel the SMS service at any time by texting STOP to the applicable short code or number where available. After you send STOP, we may send an SMS message confirming that you have been unsubscribed. After this, you will no longer receive SMS messages from that program unless you re-enroll or otherwise provide consent where required.
If you experience issues with the messaging program, you may reply HELP for assistance where available, or get help directly at [email protected]. Text messages may be sent using an automatic telephone dialing system where permitted by law. Consent is not a condition of purchasing any goods or services from TheoTrade. Carriers are not liable for delayed or undelivered messages. Message and data rates may apply for messages sent to you and from you. If you have questions about your text or data plan, contact your wireless provider.
12. App Permissions and Device Settings
The current mobile app requests notification permission to deliver push alerts. On iOS, the native notification prompt may appear after login. On Android 13 and later, the POST_NOTIFICATIONS runtime prompt may appear. The app does not currently request location, camera, microphone, photos/media library, contacts, Bluetooth, or App Tracking Transparency permission.
You can manage notification permissions through your device settings. If notification permission is disabled at the operating-system level, app push notifications may not be delivered. The app may display a banner or prompt that links to device notification settings.
13. Payments and Purchases
Purchases, subscriptions, renewals, cancellations, refunds, billing, and payment processing are handled through TheoTrade websites or TheoTrade-approved web checkout systems unless we expressly state otherwise. The current mobile app does not use Apple StoreKit, Google Play Billing, or other in-app purchase modules. Payment processors, banks, card networks, and other third parties may collect and process payment information under their own terms and privacy policies.
14. Data Retention, Account Deletion, and Deactivation
We retain Personal Information and other information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain accounts and subscriptions, send communications, resolve disputes, enforce our agreements, comply with legal and accounting obligations, maintain security, prevent fraud, and preserve business records.
Account deletion may be available in the mobile app by re-authenticating with your password, although some accounts may be routed to web-based support for deletion depending on eligibility or account status. When an account is deleted through the TheoTrade/WisePub backend, the user record is removed and active tokens are revoked. The push token associated with that user is removed from the backend at the time of account deletion, and deleted users are removed from push notifications.
If you cancel or lose subscription access, your access may be deactivated or restricted. Canceled subscribers may be removed or deactivated from push-alert access depending on subscription and channel status.
Firebase Crashlytics crash reports are currently retained for approximately 90 days. Firebase Analytics, Firebase Cloud Messaging, backend logs, chats, support records, analytics records, transaction records, legal records, and other business records may be subject to different retention periods and settings. Some logs, chats, support records, or other records may be retained indefinitely or for extended periods where reasonably necessary for business, security, legal, compliance, audit, dispute-resolution, or recordkeeping purposes, even if the user account itself has been removed or deactivated.
Because some analytics and diagnostics may be pseudonymous, aggregated, de-identified, or retained by third-party systems according to their own settings and policies, deletion of your account may not remove every historical analytics, diagnostic, aggregate, de-identified, backup, or legal-retention record immediately. Where required by applicable law, we will process deletion or access requests in accordance with applicable requirements.
15. How You Can Access, Correct, or Delete Information
TheoTrade wants to help you keep your Personal Information accurate. You may be able to view or edit certain account information in the member area, on TheoTrade.com, or through the mobile app. For the security of your account, you may be required to sign in with your login ID and password or otherwise verify your identity.
If you have questions about the type of personal data we hold about you, wish to request correction or deletion of personal data, or need help with an account-deletion request, contact us at [email protected] or write to the postal address at the end of this Privacy Policy. We may need to verify your identity before responding to a request.
16. Security
TheoTrade takes reasonable steps designed to protect Personal Information from misuse, interference, loss, unauthorized access, modification, or disclosure. These steps may include encryption in transit, use of HTTPS for app and backend communications, secure token storage on supported devices, limiting access to information, restricting physical and system access, using service providers with appropriate safeguards, and destroying or de-identifying information where required by law.
No method of transmission or storage is completely secure. We cannot guarantee absolute security of the Services, your account, your device, or your information. You are responsible for maintaining the confidentiality of your credentials, securing your device, installing updates, and configuring notification previews, permissions, and device settings appropriately.
17. Children and Users Under 18
The Services are intended only for users who are at least 18 years old. We do not knowingly collect Personal Information from anyone under 18. If you are under 18, do not access or use the Services and do not submit Personal Information to TheoTrade. If we learn that we have collected Personal Information from someone under 18, we will take reasonable steps to delete or deactivate the information, subject to applicable law and recordkeeping requirements.
18. International Privacy and United States Processing
TheoTrade is based in the United States and primarily markets its products and services to U.S. customers. We do not specifically target our marketing to the European Union or conduct business in or to the European Union in any meaningful way. If you access the Services from outside the United States, you understand that your information may be collected, transferred to, stored in, and processed in the United States and other jurisdictions where TheoTrade or its service providers operate. These jurisdictions may not provide the same level of data protection as your jurisdiction.

19. State Privacy Rights
Your rights. Depending on your state of residence, you may have some or all of the following rights with respect to your Personal Information, subject to applicable law and its exceptions: the right to know or access the Personal Information we have collected about you, including categories collected, categories of sources, purposes, and categories of third parties to which it has been disclosed; the right to obtain a portable copy; the right to correct inaccuracies; the right to delete; the right to opt out of sales of Personal Information, sharing or processing for targeted advertising, and certain profiling in furtherance of decisions that produce legal or similarly significant effects; the right to limit the use of sensitive personal information where applicable; and the right not to receive discriminatory treatment for exercising your rights. The categories of Personal Information we collect, our sources, purposes, and disclosures are described in Sections 2 through 8, and our retention practices are described in Section 14.
Sales, sharing, and targeted advertising. We do not sell Personal Information for money. Like many companies, our websites may use third-party advertising cookies and pixels that may constitute sharing of Personal Information for cross-context behavioral advertising, or targeted advertising, under applicable state laws. This may include identifiers, device information, and website activity disclosed to advertising partners. You may opt out at any time via any Your Privacy Choices, Do Not Sell or Share My Personal Information, or cookie-preference link or tool we make available on our websites, by contacting us at [email protected], or by using an opt-out preference signal. We honor the Global Privacy Control (GPC) as a valid opt-out request for the browser or device that sends it. We do not knowingly sell or share the Personal Information of consumers under 16. The TheoTrade mobile app does not use advertising SDKs, advertising identifiers, or cross-app tracking.
How to exercise your rights. Submit a request by emailing [email protected], calling 1 (800) 256-8876, or writing to the postal address in Section 22. We will need to verify your identity before acting on a request, which may include matching information you provide against information in our records or asking you to confirm control of the email address or phone number on your account. You may use an authorized agent to submit a request on your behalf; we may require proof of the agent’s authority and verification of your identity. We will respond within the time required by applicable law.
Appeals. If we decline to take action on your request, we will explain why and how to appeal. You may appeal by replying to our response or by emailing [email protected] with the subject line Privacy Appeal. We will respond to appeals within the time required by applicable law, and if your appeal is denied, we will provide information about contacting your state Attorney General or, for California residents, the California Privacy Protection Agency to submit a complaint.
Mobile app tracking. TheoTrade does not currently use the mobile app to collect advertising identifiers, request App Tracking Transparency permission, or track users across third-party apps and websites for advertising purposes. If our practices change, we will update this Privacy Policy and applicable app-store disclosures as required.
20. Social Media Features and Third-Party Websites
The Services may include social media features, links, buttons, embedded content, or integrations with third-party websites and services. These features may collect your IP address, information about the page or app screen you are visiting, and may set cookies or otherwise collect information to enable the feature to function. Your interactions with third-party features are governed by the privacy policies of the companies providing them.
Please be aware that TheoTrade may provide links to websites, apps, brokers, platforms, app stores, payment processors, video hosts, or other services that may collect Personal Information about you. The information practices of third-party websites and services are not covered by this Privacy Policy.
21. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make changes, we will revise the effective date or last updated date above and may provide notice through the website, mobile app, email, account notice, or another reasonable method where required or appropriate. We encourage you to periodically review this Privacy Policy to stay informed about our privacy practices.
